Morgan Stanley Smith Barney, LLC, et al. vs. Peter C. Foote, FINRA Arbitration No. 14-00233
Successfully defeated Morgan Stanley’s claims against a former employee for monies owed on a promissory note. Morgan Stanley’s claims for more $340,000 in damages were denied in their entirety.

Citigroup Global Markets, Inc. vs. Mamunes, FINRA Arbitration No. 12-01480
Successfully defeated Citigroup’s claims against a former employee for monies owed on a promissory note. Citigroup’s claims for more $100,000 in damages were denied in their entirety and all hearing session fees were assessed against Citigroup.

Panel finds Merrill Lynch liable for defamation and orders expungement of advisor’s U-5.

 

SUCCESSFUL APPELLATE DECISIONS

Mathews v. Cassidy Turley, et al., 435 Md. 584 (2013)
Successfully overturned trial court’s entry of summary judgment and create new Maryland law regarding the definition of an investment contract and the application of limitations under the Maryland Securities Act. An important victory for Maryland investors!

Barbour v. International Union, 640 F.3d 599, (4th Cir. 2011)
Successfully reversed trial court rulings regarding issues of removal and the doctrine of complete preemption.

Bollman v. Splash & Dash, LLC, CSA, Md. Sept. Term 2013, No. 2238 (2015)
Successfully reversed J.N.O.V. granted by the Circuit Court for Harford County and reinstated the $200,000 jury verdict.

Commonwealth Equity v. Messick, 152 Md. App. 381  (2003)
Successfully affirmed trial court’s ruling regarding the waiver of an agreement to arbitrate.
